I've never purchased from overseas or even ebay before I joined EDS so I'm limited in experience.
My story:
I bought a My-M from simon-elf on ebay. It broke the second time I used it...it wouldn't change speeds or shut off. I emailed simon and he said he would like me to send him postage or buy something else and then I guess he would send me another My-m.
At first, I thought he should send me a replacement at his cost because he shouldn't sell such a poorly made product.
I should have opened a 'resolution' at the Resolution Center as soon as the item broke but I just emailed Simon and thought it would be tattling if I opened a resolution from the get-go.
He told me to be patient and I was for a month.
I think he was buying time so that I was well outside of the 45 day period that I didn't know about at the time. Since I only use the My-m every six weeks, I might have been outside the 45 day period anyway.
The last message from Simon went like this:
thanks for your reply. we sell the needles 3usd of one. we sell this derma roller 99usd on ebay, we would like to charge you only 85usd with 5 extra needles. is that ok for you? or we put this roller for you, did you like it? pls refer to the below link: http://cgi.ebay.com/ws/eBayISAPI.dll?ViewItem&item=380466565882&ssPageName=ADME:X:AAQ:US:1123pls just confirm and let us know your decision. regardsWith Best Regards,

I really don't know what they want but how do you manage to get your replacement without being taken for a naive chump?
Any advice, please?

You should not have to pay anything if he sold you a faulty product and it broke soon after. I would just request a refund.
You do need to contact a seller directly before opening a Paypal issue, and they will ask if you contacted the seller first. You include the details of the conversation, and convey that he is requesting postage, etc. and will not just send you a replacement. Then ask for a full refund, and buy from another seller.
Btw, if you have issues you need to move quickly...no waiting a month. I was not clear from your description above exactly what was supposed to happen in that month? |

Since my needling schedule is six weeks apart and it didn't break until the second use, 45 days had already elapsed before the autoneedler broke.
From what I could tell, ebay wants you to report any problems within the 45 day period of receiving the device.
The month comes in where Simon asked me to be patient. I let a month elapse before I contacted him again. |

I would open an issue with Paypal and not worry about the 45 days. |

Hi MaryClaire,
Reading about your situation angers and sickens me as I recall my own experience with a shady seller on ebay a few years ago. My seller also said to not open a dispute with ebay and to be patient, to give him time to replace the item, and that he'll send me an extra gift for my inconvenience, etc. I would even message him for updates and he would say that it would be coming soon, new stock came in, etc.
Like you, my 45 days had past and I eventually tried to open a dispute but his account was closed and the item no longer existed and I had nothing.
That was my one ebay regret - trusting the seller without opening the dispute first. I lost out all around. The feeling of regret of not trying sucks and haunts me to this day.
You should just try opening the dispute even after the 45 days have elapsed. Email ebay about the situation if you can't do the auto-form. It's worth a try.

Uh Oh - I bought some dermastamps from this seller. Thankfully no issues as they arrived (but on the s-l-o-w boat from China LOL) |

Be sure to tell him you are taking it up with both EBay and Paypal, and will be reviewing his service poorly (if you haven't already given him good feedback which gives you one less card to play). This usually will cause a seller to rethink treating a customer badly. Their ability to sell is very much tied in with their review score.
I never give good feedback straight away. Receiving goods on time is one thing, but using the product and making sure it is of decent lasting quality is more to the point I think (I know you used it once and it worked fine so this is not directed to you specifically Mary). I think we see it on amazon and eBay a lot, people reviewing something as soon as they get it when the excitement of having a new toy is there, which doesn't always give a very full picture of the longevity of a given product. Many times the more telling reviews come much later. It is not really anyone's fault, as we are pressured into reviewing straight away (possibly because they know buyers excitement at that time). I hope you are able to get tough with this guy. Also letting him know that his name has been mentioned on a skin care site frequented by thousands might not hurt... |

I would, too. Open a "significantly not as described" dispute or some such thing. They will remove the full amount from his Paypal account and hold it until he responds. If you want to, you can 'upgrade' the dispute which forces Paypal to look into it and you are protected under their "buyer's protection" which means you will for sure get your money back.
I use Paypal every day for my own business so I know how this works. |

I've never bought any devices from ebay, and the reason is pretty much that I dont want to deal with shady sellers. It might be me being overcautious, but that is how I feel. |
