I’m awaiting the final ingredient, “Horse mane extract” (which I ordered at the beginning of last week but which still hasn’t arrived. Hmmmm...), and then it should be ready to go.
However, a wonderful EDS member pointed out to me that if I sell my lash serum to other members and someone has an adverse reaction, that person could sue me. This EDS member suggested that I a) have my lash serum tested by an independent lab, and b) purchase liability insurance.
I admit that I hadn’t even thought in terms of being hold liable if something went wrong, but since I can’t afford either of the testing or the insurance – and I really don’t have a pot to piss in so if someone tried to sue me all they would get is a portion of nothing – I’m looking at drafting a waiver that members/buyers would have to sign before I would ship a bottle of my lash serum that would absolve me of responsibility if something were to go wrong. I know that wouldn’t be a very popular move, but I also need to think in terms of protecting myself, so I may end up just sharing my recipe for the lash serum and everyone who was interested to could make their own.
This is really upsetting to me, because I know I’ve hit a home run with my serum because I’ve been testing it on my mom’s completely “virgin” and ridiculously sparse and nondescripit lashes – in case the results I was seeing on my own lashes was somehow attributable to the other lash serums that I had been using previously – and my mom is seeing incredible results, as well, so I honestly believe my serum is going to work as well as – if not better than – all of the other lash serums out there on the market, including Lucia and Ardell!
So, I don’t know – would you guys be willing to sign a waiver in order to try my lash serum? |

yes, I would definitley be willing to sign a waiver!
on the note of sharing your recipe, have you thought of SELLING your recipe to a company? You get all of us EDS members to use it and you could use our results to help sell the formula on... Personally I think that would be great, for you... Just a thought anyways |

A waiver is a great idea. What if you didn't sell the "serum", but sold a cool container that the lash serum just happened to be in??? |

I see nothing wrong woth signing a waver.. I had honestly wondered about just what the other member mentioned to you.. In this day and age, sadly, we all have to be careful of just that.. To many sue happy people out there...
Oh and what number am I in line, waiting for this??? LOL |

Signing a waiver is a very good idea. These days you never know what other people are thinking. Selling your secret to a company is a super idea.
BTW, I'll sign anything you want me to in order to try your serum. |

I would certainly be happy to sign a waiver, too. Also, Chrissie's idea of selling the bottle that the contents just so happen to be in sounds good.
If things worked out well and you could guarantee enough orders to justify the expense of testing and insurance, then maybe you could go into official production.
But selling your idea to a cosmetics company could well turn out to be your best bet if there's going to be a huge amount of potential legal hassle involved. Maybe Darren could give you some advice? |

I'd be most willing to sign any waiver that it takes. And I honestly can't wait for the serum to finally be ready, even if it's a test batch and not as perfect as you'd like it to be, I'd be happy to buy some from you!  |

I'll sign! Thanks CareKate. You know, maybe Darren can work something out with you. He has the know-how, the lab, and the company. At the least he can give some good input. Good luck with the lash serum! Hopefully, you can retire on the profits!

A pre-nup for beauty!! That's hilarious!! Of course, I would be happy to sign a waiver. It seems so sad (in this day and age) that one bad apple might make extra work for the person that intended only good!! I run a school and it is wise to be pro-active these days. I think you've really hit on a winner and I'd like to see you make some moolah for all your hard work!! Bring on the waiver!! Deb |

This serum sounds awesome! I thought several of the other posters had a great idea with regards to talking with Darren. Seems that you have a great product, so you deserve to be compensated for all your hard work in putting it together. And yes, I'd be willing to sign a waiver if need be...I just want to be able to give it a try!

As with the others who've replied, I'll sign a waiver. I don't have sensitive skin or eyes, and have yet to meet an active, botanical or other ingredient that affects my skin adversely! (other than the normal flakey/peeling from retinoid products) I do understand the concern. Heck, we have to sign waivers wherever we go these days.....horse ranches, ice skating rinks....
You need to do what you feel comfortable with. |

what is this lash serum. sounds like everyone is waiting patiently (or not so patiently) for it. Can someone tell me a little about it.
I'm new to the forum, so I just catch bits and pieces of stuff thats going on.......but I don't know the whole story.

I can't imagine u being sued, think of all the crap we put on our face and then throw out because of bad reaction, or yikes no reaction. Maybe if you just print some labels with disclaimers (patch test ect...) as skincare companies do then u'd be just fine. Didn't someone on here even have her lashes fall out with a product and I don't think lawsuit came up. Best of Luck
